本《最终用户许可协议》(以下称《协议》)是您(个人或机构团体)与上述软件(以下称“软件”或“软件产品”)版权所有人诺赛科技之间的法律协议。 在您使用本“软件产品”之前,请务必阅读此《协议》，任何与《协议》有关的软件、电子文档等都应是按本协议的条款而授予您的，同时本《协议》亦适用于任何 有关本软件产品的后期发行和升级。 您一旦安装、复制、下载、访问或以其它方式使用本“软件产品”，即表示您同意接受本《协议》各项条款的约束。 如您不同意本《协议》的条款，那么，版权所有人诺赛科技则不予将本“软件产品”的使用权授予您。 在这种情况下，您不得使用、复制或传播本“软件产品”。
本《协议》中，将软件使用用途分为“个人非商业用途”和“商业用途”：个人用途指个人在非团体机构中使用本软件并用于非商业目的；商业用途指个人用于任何 商业目的或团体机构出于任何目的使用本软件。本《协议》中对于个人非商业用途和商业用途将采用不同的授权范围和使用方式。
本软件产品受著作权法及国际著作权条约和其它知识产权法及条约的保护。
1.      许可证的授予
本《协议》授予您下列权利：
l 安装和使用:
对于个人非商业用途，即仅供个人用户用于非商业环境及非盈利活动，您可安装无限制数量的本软件的“免费版本”产品来使用。 对于商业用途，你必须预先获得版权人授权许可后才能安装和使用本软件产品。
l 复制、分发和传播:
您可以复制、分发和传播无限制数量的“免费版本”软件产品, 但您必须保证每一份复制、分发和传播都必须是完整和真实的, 包括所有有关本软件产品的软件、电子文档, 版权和商标宣言, 亦包括本协议。对于“收费版本”的软件产品，您不得在未得到诺赛科技许可的情况下进行任何形式的复制、分发和传播。
2.      限制说明
l 不得用于非法用途：
诺赛科技的所有“软件产品”均不得用于任何非授权形式的安全测试。包括“免费版本”和“收费版本”。
l 禁止反向工程、反向编译和反向汇编：
您不得对本软件产品进行反向工程、反向编译和反向汇编，同时不得改动编译在程序文件内部的任何资源。 除非适用法律明文允许上述活动，否则您必须遵守此协议限制。
l 组件的分隔：
本软件产品是被当成一个单一产品而被授予许可使用，不得将各个部分分开用于任何目的行动。
l 商标：
本《协议》不授予您由版权人诺赛科技所拥有的任何商标或服务商标有关的任何权利。
l 使用方式：
对于个人非商业用途，本软件产品准许个人用户免费使用。凡用于商业用途，均须得到版权人授权许可。
本软件产品不能用于销售或随同旨在获益的软件产品或产品包一起分发，但本软件的“免费版本”可包含在任何免费或非赢利性的软件产品或产品包里. 同时您必须保证所分发的软件包含全部文件, 并且未作任何修改。
l 个别授权:
如有任何组织或个人利用本软件以任何方式为公众服务并同时满足其自身特定目的而分发、复制和传播本软件产品, 均须得到版权人授权同意后方可进行, 否则视为侵权。
3.      版权
本软件产品（包括但不限于本软件产品中所含的任何图象、照片、动画、文字和附加程序）、随附的印刷材料、及本软件产品的任何副本的一切所有权和知识产权，均由版权人诺赛科技拥有。
4.      有限保证
l 无保证：
本软件版权人诺赛科技特此申明对本软件产品之使用不提供任何保证。 版权人将不对任何用户保证本软件产品的适用性，不保证无故障产生；亦不对任何用户使用此软件所遭遇到的任何理论上的或实际上的损失承担负责。
l 对造成损失无责任：
本软件版权人对本软件产品可能或已知问题造成的意外，连续，直接或间接损失不承担任何责任(包括利益损失，商业中断，信息丢失或其他任何经济上的损失)。
5.      终止
您可以随时通过永久删除本软件来终止此处所有的服务条款。如果您未遵守这些服务条款中的任何规定，您的权利会立即自动终止，诺赛科技不再另行通知。在这种 情况下，您必须立即删除本软件及所有内容。在法律允许的最大范围内，诺赛科技保留由于任何原因随时终止本协议以及终止您对本软件的使用的权利。
6.      责任免除
您同意对于由于使用本软件或违反此处服务条款引起的或与之相关的任何索赔、起诉或诉讼（包括由索赔、损失、损害、起诉、审判、诉讼费或律师费而引起的各种 责任和费用），您应保护诺赛科技及其管理人员、代理和员工，保证他们免于承担责任。 如果出现类似情况，诺赛科技会向您提供书面通知，告知您我们遭到了类似索赔、起诉或诉讼。
7.      其它
本软件版权人 诺赛科技 对本协议拥有最终解释权。
8.    需要遵循的相关法律法规
a) 中华人民共和国中关于计算机犯罪 刑法的相关条文：

第二百八十五条：(非法侵入计算机信息系统罪)违反国家规定，侵入国家事务、国防建设、尖端科学技术领域的计算机信息系统的，处三年以下有期徒刑或者拘役。

第二百八十六条：(破坏计算机信息系统罪)违反国家规定，对计算机信息系统功能进行删除、修改、增加、干扰，造成计算机信息系统不能正常运行，后果严重 的，处五年以下有期徒刑或者拘役；后果特别严重的，处五年以上有期徒刑。违反国家规定，对计算机信息系统中存储、处理或者传输的数据和应用程序进行删除、 修改、增加的操作，后果严重的，依照前款的规定处罚。故意制作、传播计算机病毒等破坏性程序，影响计算机系统正常运行，后果严重的，依照第一款的规定处 罚。

第二百八十七条：(利用计算机实施的各类犯罪)利用计算机实施金融诈骗、盗窃、贪污、挪用公款、窃取国家秘密或者其他犯罪的，依照本法有关规定定罪处罚。


b) 中华人民共和国刑法修正案(七) 关于计算机犯罪新增的条款：

九、在刑法第二百八十五条中增加两款作为第二款、第三款：“违反国家规定，侵入前款规定以外的计算机信息系统或者采用其他技术手段，获取该计算机信息系统 中存储、处理或者传输的数据，或者对该计算机信息系统实施非法控制，情节严重的，处三年以下有期徒刑或者拘役，并处或者单处罚金；情节特别严重的，处三年 以上七年以下有期徒刑，并处罚金。

“提供专门用于侵入、非法控制计算机信息系统的程序、工具，或者明知他人实施侵入、非法控制计算机信息系统的违法犯罪行为而为其提供程序、工具，情节严重的，依照前款的规定处罚。“

《互联网电子公告服务管理规定》
《互联网站从事登载新闻业务管理暂行规定》

Separation of Components.
The SOFTWARE PRODUCT is licensed as a single product. Its component parts may not be separated for use on more than one computer.

Software Transfer.
You may permanently transfer all of your rights under this EULA, provided the recipient agrees to the terms of this EULA.

Termination.
Without prejudice to any other rights, the Author of this Software may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.

3. COPYRIGHT

All title and copyrights in and to the SOFTWARE PRODUCT(including but not limited to any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the SOFTWARE PRODUCT, except dictionaries and its contents which the SOFTWARE PRODUCT can use), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by the Author of this Software.

All rights or copyrights of dictionaries or contents which you can visit by the SOFTWARE PRODUCT belong to their authors, and maybe they are protected by copyright laws and international treaty provisions. The license doesn't provide you with all rights of using these contents. You must get agreement and license of owners of these contents before you used them.

4. LIMITED WARRANTY

NO WARRANTIES.
The Author of this Software expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or non-infringement. NO LIABILITY FOR DAMAGES.
In no event shall the author of this Software be liable for any special, consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if the Author of this Software is aware of the possibility of such damages and known defects.
